Portugal Visits - Plymouth - Kates Book

Something Fishy - Madeleine McCann and Plymouth

With reference to my previous post about the disappearance of Madeleine McCann and in view of the publicity once again being garnered by the case, this is probably a good time to re-show the astrological mapping technique which I revealed in 2007 firmly links Madeleine to Southern Portugal (Praia da Luz) and to the area of Plymouth +/- 30 miles which therefore encompasses Exeter. Having read those lists, it doesn't take a rocket scientist to see that this Portugal/Plymouth (Exeter) link probably needs pursuing when the Metropolitan Police Force review the case. Not least because whilst reading the book, Madeleine, I noted there is a discrepancy in it regarding the number of times that Gerry McCann had visited Portugal before the fated trip in 2007.
Kate McCann alludes to the fact in her book that she feels very alone and as if no one is paying attention to the minute detail,  like she is, in the search for her daughter. However, I can assure her there are plenty of mothers, fathers and people from all walks of life and professions who have followed every nuance of this over the years in the hope of helping her to locate her little girl and solve this mystery. Not only is there a burning desire to see justice done, but if we don't know what really happened how can anyone prevent it happening again.

So with super sleuth hat on, in Gerry McCann's Witness Statement (
see here) taken in the presence of an interpreter, Natália Carvalho Ferreira de Almeida in 2007, it says 'When asked, he said that he had already been to Portugal in 1994. He stayed in an apartment on the outskirts of Albufeira. He has only returned to Portugal on this occasion'

but on page 42 of her book Madeleine, Kate says:

"I'd never been to Portugal, although Gerry had been there on a couple of golfing trips a few years before"
There may be an easy explanation but as one assertion is in a legal statement and the other in a book which is seeking to convey only the facts so that her daughter might be located, I found this a bit strange. Did Gerry have recent connections to Portugal or not? The police will surely have checked with passport records.
Kate McCann was born under the sign of the fishes, Pisces. The sign is also associated with sacrifice and rose coloured glasses. This is also the sign which exists on the Chaos/Control Pisces/Virgo spectrum, compounded by the controlling Mars/Saturn conjunction in her natal chart, in Kate this could give rise to extremes of self denial and 'control freakery'. Pisceans are great at empathising and intuiting but not always so good as sorting fact from fiction, although their life path might require them to face that very task.

So if Kate is telling the truth in her book, she may just have got 'confused'. Either that or the more unpalatable option exists that Gerry was not telling the truth to her (and she believed him) and/or he was not telling the truth in his statement. The final possibility is that it was simply a very bad translation error so I am not trying to imply anything here, just noting the discrepancies. I'm also not implying that Gerry McCann took his own daughter but the astrology does show that there may be something he's involved with or has been involved with which made his daughter a target and it's surely worth ruling out.

What is the extent of these connections back to England and how could it have impacted the choice to holiday in this resort in 2007?

One other discrepancy I noticed, having previously read all of the witness statements, is that Kate McCann says that when she went into the apartment to do her check (where she discovered Madeleine missing) she glanced over to Madeleine's bed and at first couldn't make out in the dark if she was there or not and didn't want to put the light on, but in Matthew Oldfield's statement he said it had been light enough at the previous check to see the twins breathing in their cots without even getting as far as the bedroom door. Both of these statements can't be right; it has to be extremely light to see a baby (babies) chest rising and falling as they breathe.

Matthew Oldfield's statement, verbatim, says: "So I approached the room but I didn't actually go in because you could see the twins in the cots and one of the, you could see the twins in the cots because they're in with, sort of the cots were in the middle of the room with sort of a gap of about sort of maybe a foot between the two, the cots had sort of got that fabric end and sort of a mesh side, so you could see the sides and you could see them, erm, see them breathing and there were two there and it was all completely quiet. And the other things you could see in the room, there was a, there was another bed at the back underneath the window at the far side and you could see the end of the bed, another bed here".

The statements say that Matthew had earlier listened in on Madeleine and the twins by standing close to the shutters but upon returning to the table he says that he thought it was a bit odd when Gerry insisted on going again to check - despite the fact that there was an obviously more relaxed attitude about who checked who's kids on that particular night.

He says: 
"So, erm, back to the table, erm, we have, oh, back to the table, Gerry got up to go and, to go and check on his kids, I mean, and I'd come back and said, you know, I didn't hear any noise when I listened outside your room, so I thought it was a little bit odd that, you know, not kind of a wounded pride that he sort of didn't trust me, but, erm, I just thought, oh, you know, I've just checked you don't really need to check and sort of, you know, sort of go back, but, erm, he sort of got up and went back to check on, erm, on his kids"

and in the interview

4078 "Okay. So Gerry has gone off almost straight away after you got back?"
Reply "Yeah".
4078" And then Jane followed him?"

How annoyed was Matthew Oldfield by this? What did make Gerry go back?

Some of the more obvious questions don't even seem to have been raised or answered in Kate McCann's book. Who for example, except the cleaners, tradespeople who had visited the apartment and the friends in the group would have known that  children were sleeping in that room and therefore that particular shutter was the one to aim for if, as Kate informs us, Mark Warner had originally put the cots in the other bedroom. (See p45). Which in turn raises the question, who could have had a key to the apartment?

Did friends of the apartment owner** Ruth McCann (no relation) and previous guests of theirs at that apartment still have keys?? Had the apartment ever been on the market. Did an Estate Agent ever have a key to it? Perhaps the shutter was raised - as Kate McCann says it was - to ensure no-one was outside the front door (See p46) when they left via the door or to ventilate the room of the odour of something and not open for someone to climb through. Who had the key to the apartment in their possession that night? If an intruder entered by the open patio door they surely wouldn't need a key to exit by the front door anyway and finally I have to ask this one although I have never been able to bring myself to suspect the involvement of Mrs McCann; why did she not immediately start calling, if not screaming Madeleine's name out when she discovered her missing?

Although the Tapas bar was in almost full view of the apartment's balcony Kate McCann didn't scream across from there and stay to protect her remaining children from harm but ran all the way down the path to the entrance from the street before saying words to the effect of 'She has gone' - this is not conjecture, all the witness statements confirm this. Why would someone who by her own admission many times in the book is almost paranoid about her children's safety, health and wellbeing do that?
Venus was coming into alignment with Pluto that night, Venus rules Taureans and Pluto Scorpio's. What people born under the birthsign of Scorpio was Madeleine (Venus) connected with on that holiday - especially those with connections to Plymouth? Or does Pluto describe an obsessive person and not a Scorpio? The aspect for Venus and Pluto is one I have written about on many occasions, it's not only connected with hidden financial matters but also hidden passions and the 'if I can't have you nobody else will' type jealous (and often obsessive and revengeful) passion or the 'that will teach you' type retribution. Was everybody in that group faithful to each other? Was there some seething hidden resentment occurring somewhere or money owed? By taking Madeleine one thing was for sure, both parents would openly suffer, no one's life would remain the same and the group would be bonded together for life.

None of the questions asked so far have unearthed a motive for this crime so surely it is time to start thinking out of the box?

Robert Murat and Angus Symington, son of the owner of the Ocean Club Complex. ("estate agent Angus Symington, 37, has almost identical hair, complexion, facial features, height and build and wears similar glasses." - Madeleine: Robert Murat has a double - mirror.co.uk)

In 2007, Madeleine McCann disappeared from the Ocean Club Complex in Praia da Luz in Portugal.

Reportedly, the Ocean Club Complex is owned by David Symington, father of Angus Symington.

At http://www.thesargeants.net/, 25 October 2008, (Cached ) Blackwatch asked "Is Ocean Club Owner David Symington related to Robert Murat?"

Author Blackwatch made the following points:

1. It been suggested that Robert Murat could be related to David Symington.

2. The Symington family appear to have links to some of the most senior figures in the British Establishment.

3. The Symingtons are the world's largest and most powerful Port producers. They are also involved in property.

4. Robert Murat's family were in the Oporto Wine Business. Robert is the son of John Henry Queriol Murat, a leading property developer in Portugal, who helped turn Praia da Luz into a high-class resort.


5. It has been alleged that the Murats and the Symingtons may be related through the Atkinson family:

Symington Family are descended from Andrew James Symington and Beatrice Atkinson who married in Oporto in 1891 (family's website.)

Andrew James arrived from Scotland in 1882 while Beatrice was descended from John Atkinson - the wine merchant - who had lived in Oporto since 1814.

Atkinson was descended from first British Consul in Lisbon and Oporto - Thomas Maynard - who was appointed to his position in 1656 by Oliver Cromwell.

Apparently Robert Murat is a descendent of Beatrice Atkinson's first Aunt, Maragret Atkinson who married the Oporto Wine Magnate, Henry Murat in the mid-to-late1800s (both Henry and Queriol Murat were grandson and great-grandson of Peter Murat, one of the earliest Port Shipping Merchants in Oporto - view Murat-Symington Tree).

Apparently, Robert James Queriol Evelegh Murat (Robert Murat) could be a descendent of Thomas Maynard - the first English Consul of Lisbon and Oporto.


6. In January 2008, the Daily Mail reported that Robert Murat and another Ocean Club property developer, Angus Symington bore an 'astonishing likeness' to each other. 4

The story was used to raise doubt about the reliability of the eight Tapas witnesses placing Robert Murat at the Ocean Club on the evening of May 3rd 2007.

We also learn that the Ocean Club Owner's Family is linked to John Major; and we learn news about Riad El Fenn Hotel, Morocco

"John Major is an old friend of the Symington family...

"Major's former Political Secretary Howell James ... owns a hotel in Marrakech, Morocco - the very place that Madeleine McCann was spotted in May last year. James co-owns the Riad El Fenn hotel"

On 14 May 2007, police searches began at Casa Liliana, a villa owned by Jennifer Murat, a British citizen, near the apartment where Madeleine went missing.[34] [35]
Jennifer Murat's son Robert Murat, a frequent visitor to the villa who has dual British-Portuguese nationality, had drawn the suspicion of Lori Campbell, a Sunday Mirror journalist, who informed the police.[36][7]

2. PHONECALLS BETWEEN MURAT AND MALINKA
The police were understood to have taken in for questioning Sergey Malinka, 22, a man of Russian origin, from whose property officers also took away a laptop computer and two hard drives. Malinka had set up a website for Murat and the two exchanged frequent phone calls since Madeleine's disappearance — the reason the authorities started suspecting him.[41][42]
Malinka denied he had contacted Murat, and said he was "completely innocent".[44] Inconsistencies in his account of his relationship with Robert Murat emerged: he had said he had not contacted Murat in a year but Murat’s mobile phone records allegedly show he called Mr Malinka at 23:40 on the night Madeleine went missing.[45][46]
3. MURAT SEEN OUTSIDE THE HOLIDAY COMPLEX
Detectives from the Polícia Judiciária questioned three friends of the McCanns who were dining with them at the time of the disappearance, Rachael Oldfield, Russell O'Brien and Fiona Payne, "to go over their accounts of events on 3 May". The three were also brought face to face with Murat.[50] As a result of the interviews, police examined discrepancies between statements from the three friends and that from Murat, in particular claims from the friends that they saw Murat outside the holiday complex on the night of the disappearance when he had stated that he was at home with his mother.[50]

This means eight witnesses saw Murat near the apartment that night and 'blows to bits' Murat's alibi that he was at his mother's house the entire night Madeleiene went missing.
On the afternoon of May 3, the day Madeleine vanished, the two sisters noticed two men acting suspiciously on the ground floor balcony of an apparently empty apartment overlooking the swimming pool of the complex where Madeleine had been staying.

At around 10.30 in the evening of May 3, the two sisters noticed a man standing and smoking a cigarette in the reception area.

The following day the two sisters went to the local police to report the two suspicious-looking men.

As the police walked with the sisters towards the apartment, where the two men had been seen, Murat offered his services as a translator. The two sisters recognised Murat as the smoking man from the previous evening.

The two sisters invited Murat for a drink. One sister, Jayne Jensen told police she thought Murat’s behaviour was strange, and her suspicions were further aroused when he said he needed to change his clothes because he had been wearing the same outfit all day.

He was dressed in a navy blue T-shirt and jeans, he was very sweaty, and his comment was, ‘I must go and shower and change, I’ve been in these clothes all day.’

Michaela Walczuch reportedly claims she was at a Jehovah's Witness meeting four miles away when Madeleine McCann was snatched.

Friends of Michaela said Walczuch was at the Jehovah’s Witness meeting on May 3 and that police had confirmed this.

But church elder Brother Teofilo Castela has said: "She was thrown out of the church more than a year ago and doesn't attend."

He added: “I haven’t been interviewed by the police. They haven’t been here.”

Another witness said, "I haven’t seen Michaela all year. She’s been thrown out."

Reportedly, Portuguese detectives have not bothered to test Walczuch's alibi by talking to any of the Jehovah’s Witnesses in Lagos, near Praia da Luz.

The Daily mirror, 20 November 2007, refers to:Robert Murat, who was spotted near Madeleine McCann's holiday apartment the night she vanished, despite him insisting he was at home nearby.

Murat's girlfriend Michaela Walczuch, named by the Mirror as the woman spotted bundling a child into a car two days after Maddy vanished. (Witness 'saw Murat's girlfriend with Madeleine')

Michaela's estranged husband Luis Antonio, a pool cleaner who worked at the resort where Madeleine McCann vanished.

A woman has told detectives from the Spanish Metodo 3 agency that Michaela Walczuch, 34, handed over a girl looking like Madeleine to a man in a car just two days after Madeleine vanished.

The witness said Walczuch took the child from her car and bundled her into the other car in central Portugal, 90 miles away from the resort of Praia da Luz.
5. DNA

"According to sources quoted in the newspaper 24 Horas, DNA samples found in Robert Murat's house were Madeleine's." - Madeleine's DNA was found in Murat's house, police claim the ..

David James Smith, in The Sunday Times (UK), 16 December 2007, (Kate and Gerry McCann: Beyond the smears) writes about the Madeleine McCann case:

"The man Jane Tanner had seen carrying a child was walking straight towards the Murat villa.

"Murat later said to me that he told the PJ (police) the press were suspicious of him, and they told him not to worry and to keep away from the press and work for them instead. He had signed papers to become an official interpreter and even sat in during the witness interview of Rachael
Oldfield...

"Murat always denied he was out the night Madeleine disappeared, but three of the McCann group claimed at the time they had seen him and still insist they were right. I was told there was at least one new independent sighting of Murat out on the night of May 3...

"There is no published evidence that Madeleine’s DNA, or any trace of her blood, has been recovered from the apartment or the car...

"I heard that a PJ officer had been surprised to find a
member of MI5 at a UK meeting about the case, and this made him suspicious that shadowy forces could be at work.

"The Sol journalist Felicia Cabrita mentioned the 'mysterious Clarence' – Clarence Mitchell, the former government PR officer turned McCann spokesman – and I was told there was suspicion too about another government official, Sheree Dodd, who had acted as a PR officer for the McCanns briefly in the early days..."

In the Black Vault forums (The Black Vault Forums-viewtopic-Madeleine McCann's Disapperance) we read the following:AULO Reis, of gazetadigital, in Portugal : Robert Murat came back to Portugal, days before Madeleine was kidnapped, and he was accompanied by another man...
Murat went to Praia da Luz, while the other man stayed near Lagos city. Questioned about this detail, Portuguese CID refused to comment...

One of those witnesses noticed that a person who was on the pictures, talking with Robert Murat and following a canine unit of GNR (Portuguese Rural Police) was also in several web pages, but near Gerry McCann, Madeleine and the twins.

The picture (1) was taken before Madeleine was kidnapped, and is clear that the place is inside the Ocean Resort. The man in question, with shaved hair, sunglasses and strongly build, appears in several photos, published in British and Spanish newspapers, among Police officers and close to Robert Murat. Our question to Portuguese CID about this man received the same answer: no comments, details of the investigation are covered by Secrecy Law.

1. On 1 December 1991, the Independent on Sunday referred to former Police Superintendent Gordon Anglesea and children's home Bryn Estyn in North Wales (Chief Superintendent Gordon Anglesea.):

"According to former residents at Bryn Estyn, Gordon Anglesea, a former senior North Wales police officer, was a regular visitor there. He recently retired suddenly without explanation. Another serving officer has been accused of assaulting a child at Ty'r Felin."

On 27 January 1993, Private Eye magazine (Chief Superintendent Gordon Anglesea.) had an article about the North Wales investigations criticising what it regarded as the apparent reluctance of the North Wales Police to prosecute "no fewer than 12 serving and former colleagues" for sexual offences involving young boys who had been in care over a 20 year period.

"The reluctance has nothing to do with the involvement of a number of the local great and good as members of a paedophile ring, which regularly used homes, like the now-closed Bryn Estyn near Wrexham, to supply boys for sex to local celebrities.

"In the late 1970s, Superintendent Anglesea of the North Wales Police was appointed to investigate an allegation of buggery made by X against the son of a then member of the North Wales police authority. The Superintendent found there was no case to answer. Coincidentally the police authority member and Superintendent Anglesea were prominent masons."

4. Anglesea brought proceedings for libel.
The defendants relied upon the evidence of three former Bryn Estyn residents.
Two of them alleged that Anglesea had both indecently assaulted and buggered them.
The third gave evidence of a joint indecent assault by Anglesea and house master PeterHowarth.
Two other witnesses, a housemother at Bryn Estyn, who was also a policeman's wife, and a probation officer who had been attached to the staff of the home for three months whilst on a training course gave evidence of having seen Anglesea at Bryn Estyn.
Gordon Anglesea won damages of £375,000.

The mother of three has confided to friends she believes there are questions about the British expat that need to be answered.

Mrs McCann's doubts emerged after the Daily Mail reported that seven witnesses claim to have seen Mr Murat near the McCanns' holiday apartment on the night of May 3.

He has always insisted he was at home all night at the villa he shares with his elderly mother in Praia da Luz, near the Mark Warner holiday complex.

L.  Mrs Jennifer Murat’s evidence

We now look at what Robert Murat’s mother, Jennifer Ann Murat, had to tell police. She gave her family history and that of Robert, which we dealt with above.
Dealing with recent events, she confirmed that she had gone to fetch Robert from Faro Airport at 9.30am on 1 May, adding that he’d been in England since 10 March [this date is not certain].
On the evening of 3 May 2007, the night Madeleine was reported missing, Mrs Murat said she was at home with Robert. She says she went out at 7.50pm to buy bread from the Batista supermarket, part of her normal routine. She returned to the house where she arrived ‘more or less at the same time’ as Robert.
They sat in the kitchen, talking and eating. She remembers that they were talking until close to midnight about his Romigen project and their website, romigen.com.
She recalled hearing sirens, but couldn’t remember the time and thought it was probably an ambulance. She heard no noise nor was aware of any unusual movements of people. No-one knocked on the door to ask for help in finding a missing girl. She is sure that Robert did not leave the house that night.
One curious feature of that evening’s events - which the police did not ask her about - is a record of telephone calls made to or from her landline and on her mobile ’phone. These have been disclosed by the Portuguese Police. We reproduce that record here, noting that the record does not unfortunately show which way the calls were made:
5.25pm. Mobile telephones call to or from Mrs Murat’s domestic help and friend of the family, Luzia Carvalho, generally called ‘Lucy’.
5.41pm. Mobile telephone call to the ‘message centre’ for the mobile ’phone.
The following calls are all to or from Mrs Murat’s landline:

6.15pm. Telephone call to or from Spanish mobile 616610XX6. Duration 56 seconds.

There was also a telephone call to or from Michaela Walczuk on Mrs Murat’s landline, at 8.15pm, lasting 10 minutes.
There is a reasonable doubt here about whether Mrs Murat made or received those calls, or whether someone else did. A possible explanation for the record of short calls lasting under a minute, followed by the 3-minute call at 7.48pm, is that someone was telephoning another number and leaving a voice mail message each time, perhaps urgently wanting that person to ring back.
That could account for so many call durations of just under one minute - long enough to leave a short message. Then perhaps at 7.48pm there was an actual conversation. Why did Lucy, her cleaner, and Mrs Murat (if it was her) need to speak to each other that evening? The police appear not to have asked Mrs Murat about these calls.
Returning now to her police interview, Mrs Murat said that she first learnt about Madeleine disappearing on the morning of Friday, 4 May. She said she heard the news from her daughter Samantha, who was living in Exeter at the time. Samantha had telephoned early in the morning with the information that, according to news bulletins in England, a British girl, Madeleine, had gone missing the night before in Praia da Luz.
Mrs Murat said that “Because I’ve been in Portugal for a long time and know many people’, she decided to set up a table near the cinema in Praia da Luz to try and collect any useful information about Madeleine’s disappearance. She said that his was “To investigate aspects of the whole matter and pass anything useful to the police”.
She did this over a three-day period, from Friday 11 May to Sunday 13 May. She added that she thought people might give information to her in case they felt intimidated by the police and were frightened to go to them. A number of people did not find that reason convincing.
M. The evidence of Portuguese journalist Maria Cecilia Pereira Pires
Now we come to an interesting statement by a journalist working for the Portugal Resident, Maria Pires. She makes it on 23 May, just 20 days after Madeleine was reported missing.
She explained that on 4 May 2007, she was asked to go to Praia da Luz to cover the disappearance of Madeleine, arriving at between 9.30am and 10.00am. She went to the temporary police office and then spoke to a group of journalists. She proceeded to take a stroll around the resort, partly because she was told that the missing child might still be in the imminent vicinity.
Walking northwards out of the village, and coming across a bare patch of land, a man about 50 years old approached her, asking her if she was involved in searching for the missing child. Ms Pires said she was. The man then suggested they both go together to look around what seemed like a nearby unoccupied house, to see if Madeleine might be there.
The two reached a car parking area within the residence and called out to see if anyone was at home. They found a woman around 70 years old, about 5’ to 5’4” in height [150cm to 160cm], with grey hair combed and coiffed in the shape of a banana. The woman agreed to join in the search.
They left the house heading for the swimming pool, with the older woman lagging behind. The woman, speaking in English, said she was very distressed with the situation and expressed the view that the parents must be suffering great anguish. She said that where she lived was just 100 yards or so distant from the resort and said that she had heard police sirens around 10.00pm the previous night. She also volunteered the information: “I was having dinner with my son around 10.00pm”.
The woman also went on say that she had learnt that Madeleine had gone missing on the evening of 3 May and volunteered the information that: “My son is working with the police trying to find the child”. Later that week, Ms Pires came to learn that the woman whose house she had been taken to was Mrs Jennifer Murat, Murat’s mother.

Ms Pires then recalls that as early as Saturday 5 May, some British journalists were saying that Robert Murat might be under suspicion for being involved in abducting Madeleine. Ms Pires says that at this point Murat was shocked, said he was going to back out of his helping the police and journalists, and then became very difficult to contact.
A few days later, she noticed a woman sitting at a kiosk set up to receive information about Madeleine. The woman was Jennifer Murat. She read some hand-outs provided by Mrs Murat and recalls being taken aback by one sentence on that hand-out. That sentence read that: ‘The child had gone missing at 7.00am on Friday 4 May”. The hand-out said she had been told this as the result of a telephone call. Ms Pires found this very strange, given that Ms Murat had in fact said something different to her during the morning of 4 May.
Ms Pires said she’d gone to the police after seeing this hand-out. She told the police that she [Ms Pires] knew with absolute certainty that Mrs Murat knew that Madeleine had disappeared at an earlier time, given all that Mrs Murat had said to her that morning.
Ms Pires had no doubt what was going on in Mrs Murat’s mind. She told police that she was certain that this was an attempt by Mrs Murat to construct an alibi, probably for her son, about the events of the evening of Thursday 3 May.
N.  Robert Murat’s meetings with Brian Kennedy in Portugal, 13 November 2007
We’ll now move right away from the events of early May 2007 and look at two meetings that were probably of great significance in this case that took place in Portugal in November 2007. One was between Robert Murat and Brian Kennedy, the multi-millionaire double glazing magnate who has effectively bankrolled the various private investigations which were supposed to be about finding Madeleine.
Others were also present at this meeting. He was also, as was made clear in John Whitehouse’s article on our website, the man who was at the centre of these intelligence operations, running them from a house believed to be in Knutsford, appointing the staff and directing them.
The other meeting was between Brian Kennedy, the Portuguese Police, and the Spanish private detective agency recently chosen by Kennedy and the McCanns: Metodo 3. This took place in police headquarters in Portimao.
A report from the Portuguese Police referring to a ’phone call on 19 October, gives us some background; here it is:
“On the 19th of October, we were contacted by Alberto Carbas, Chief of the Kidnapping Unit of the Commissary-General, based in Madrid, who passed to us the information that the McCann family had contracted a Spanish private detective agency known as ‘Metodo 3’. The costs of their investigation into Madeleine McCann were being covered by a Scottish multi-millionaire whose name is Brian Kennedy. His objective was to find Madeleine.

“We were asked if we were available and interested in meeting with a representative of Metodo 3 and the Spanish Commissary General and Chief of the Kidnapping Unit of the Police in Spain. The purpose of this proposed meeting, they said, was to find out the truth, but they stated that they would not interfere in police work. At most, they said, they would ‘complement’ our investigation.  They firmly stated that they are not working directly for the McCann family, but for Brian Kennedy. They didn’t ask for any information regarding the investigation, nor was any offered to them, for obvious reasons”.
We now know that Brian Kennedy flew out in November 2007, about three weeks after this ’phone call, together with his in-house lawyer from the Latium Group, Edward Smethurst. This, briefly, is the Portuguese Police’s account of a meeting between them, Metodo 3, Brian Kennedy and Edward Smethurst. The date of it was probably arranged during or soon after the ’phone call of 19 October:

“We held a meeting on 13 November, with Inspectors Paulo Ferreira and Ricardo Paiva present, with Brian Kennedy, Director of the detective agency, Francisco Marco and one of his advisers, plus Antonio Jimenez, ex-chief of the Kidnapping Unit of Catalonia [Note: Other information suggests that Edward Smethurst was also present].
Brian Kennedy insisted that his motives were purely charitable, aimed at finding the truth, and generally helping missing children. He said he was interested in discovering the truth even if the McCann family, the friends, or any other person is found to be involved in the disappearance”.

Brian Kennedy’s involvement in the investigation into the disappearance of Madeleine McCann has been controversial. An article by Mark Hollingsworth in the Evening Standard in August 2009 claimed that “The involvement of Brian Kennedy and his son Patrick in the operation was counter-productive, notably when they were questioned by the local police [in Portugal] for acting suspiciously while attempting a 24-hour ‘stake out’.” 
The ‘Evening Standard’ article also showed that, later, the relationship between Metodo 3 and the Portuguese police had ‘completely broken down’. Hollingsworth claimed that key witnesses were questioned ‘far too aggressively’ by Kennedy’s investigators, so much so that ‘some of them later refused to talk to the police’. Interference with witnesses to that extent could amount to a criminal offence.
We are not aware that any other nation allows people to interfere with potential witnesses in an investigation in such a way as to cause them to refuse to testify, as Mark Hollingsworth in his article claimed had happened in this case, due to Kennedy’s investigators.
It was Francisco Pagarete, Mr Murat’s Portuguese lawyer - the one whom he was so anxious to see when he flew out to Praia da Luz on 1 May - who confirmed that a second meeting involving Brian Kennedy took place at Mr Murat’s uncle’s house in the Algarve in November. He told the BBC: “[Brian Kennedy] came here to give his support to Robert and to say he doesn’t believe Robert was involved in this story in any way or sense. And he asked if Robert could help the investigation for the finding of Madeleine in any way”.  Mr Pagarete added that Mr Kennedy had ‘promised to stay in touch with Mr Murat’ but ‘had not contacted him since’. Mr Pagarete also confirmed that Edward Smethurst was at the meeting.
The Portuguese paper Jornal de Notícias appeared to have some additional information about this meeting. Their report, early in 2008, said: “The meeting - a dinner that Brian Kennedy asked to be discreet and far away from the eyes of the press - took place in the end of last year at a house of Murat's relatives in Burgau (Vila do Bispo). At the dinner were Robert Murat and Kennedy, their respective lawyers, Jennifer Murat and the aunt and uncle of Murat” [NOTE: This appears in fact to have been Ralph Eveleigh, Murat’s uncle, and Sally Eveleigh, his cousin].
If Murat and Kennedy each had one lawyer with them - Pagarete and Smethurst - that makes seven people present at that dinner in Burgau:  Murat and his mother, his uncle Ralph and cousin Sally Eveleigh, who ran the 8-room guest house at Vila do Bispo, two lawyers and Brian Kennedy.
What was discussed at this meeting that Kennedy didn’t want the press to know about?
This evening meeting was either on the same day, or very close to, the meeting that Brian Kennedy had with the Portuguese Police on 13 November 2007 that we referred to above. The two Portuguese Police Inspectors, Ferreira and Paiva, later submitted an account of their strange meeting with Brian Kennedy.
The report, which is amongst the documents contained in the police files,  indicates that right at the start of the meeting, Brian Kennedy was keen to stress that his intentions were ‘purely charitable’, because he felt ‘concerned about cases of child neglect and child abduction’. The Director of Metodo 3, Francisco Marco, presented information to the PJ about three situations, allegedly received via their ‘hotline’.
The first of these concerned an incident that the British media had already referred to, at the end of October 2007: a woman who had been baby-sitting at the Ocean Club, in Apartment 5A in August/September 2006, said she spotted a man ‘hidden in the shadows’, the same day that Madeleine disappeared. A story about this had surfaced in the Sun on October 31.
According to the newspaper, “The nanny - identified only as M.H. - reported the frightening incident to the police in England after the hunt for Madeleine started in May, but did not speak to the police in Portugal”. Clarence Mitchell added that: “This evidence supports what we have always said, that Maddie was taken from her bed by an abductor”. The Portuguese Police had however ruled out this report, because the detectives considered that there was no proof that it was in any way related to Madeleine's disappearance.
The second piece of information was about the alleged existence of images of paedophilia on a computer at the home of Sergei Malinka, witnessed by the fiancé of a British woman, four years ago, when he was at Malinka's house. According to this witness, he questioned Malinka on the subject and he explained that the computer belonged to a client and that he would report it later to the authorities. All of the computers at Malinka's house were seized and examined, but the Portuguese Police report said that nothing of any relevance or suspicion was found.
The third piece of information referred to a detailed witness statement, according to the Metodo 3 report, about a woman handing what the witness was convinced was a child, wrapped in a blanket or a sheet, over a fence to a man, next to two parked vehicles, near a town 100 miles from the Algarve. The witness, a Portuguese lorry driver, M.G., looked at several photos and picked out Michaela Walczuk [Robert Murat’s girlfriend, now his wife], saying that her picture was the one that most resembled the woman he had seen.
The British media published a version of this story on 19 November 2007, but with different details. The METRO free paper boldly wrote: “A witness spotted Murat's German girlfriend, Michaela Walczuch, in a car with Maddie, on 5 May, in central Portugal”. On the same day, the Daily Mail published a similar story: “According to a source, a new witness identified Michaela Walczuch as the woman seen with the missing child, in central Portugal, 160 kilometres [100 miles] from where she disappeared on May 3rd”.
As usual, Clarence Mitchell had a few things to say to the media: “We are not going to comment on any line of the investigation except to say that we are encouraged by the fact that our investigators seem to be making progress. Kate and Gerry are not ruling out any possibility”.
The Portuguese Police studied this incident and questioned the Portuguese lorry driver, but the facts that he described to the police were somewhat different to those reported in the British press. The lorry driver said he saw a woman handing something to a man, over a fence, wrapped in what looked like a blanket. It wasn't heavy, because they did it easily and the fence was around 1.6 metres high (5 feet). Asked if it could have been the body of a child, he responded that nothing he had seen would indicate that.
Questioned also about the positive identification of Michaela Walczuk, according to Metodo 3's report, the witness told the Portuguese Police that he couldn't see the woman's face, because he was driving his lorry at 45/50 mph, and the couple were at some distance. He only chose Michaela's photo from amongst the others Metodo 3 had shown him because she had the same hair colour and similar build.
The actual facts which emerged from the lorry driver, then, did not seem anywhere near sufficient to justify the press headlines claiming that he had positively identified Murat and his girlfriend.

O.  Murat’s friend Sergei Malinka has his car torched

In March 2008, whilst Robert Murat was away in England for a short period, his friend, Sergei Malinka, had his Audi A4 car torched beyond repair. Beside the car, on the pavement, was written in red paint the word ‘FALA’. That means: ‘Talk’. However, it was uncertain if that was a message saying he should talk or, more likely, a message warning of what might happen if he did talk.

Malinka was described in the press as ‘An associate of official suspect Robert Murat who was designing a website for him at the time Madeleine disappeared’.
The car had been parked close to his flat. Malinka put his own interpretation on the torching of his car, and he chose an interesting tack: “Who the hell has written that? What exactly do they want me to say? They must be talking about Robert. There's nothing to say. I'm angry that someone would do this and I want to find out who it was. I'm not scared. It's just a car. It was a nice car, but at least I wasn't inside it. But I have no feelings about this. They ripped my heart out last summer when they involved me with all this”.

Press articles pointed out that when police eventually seized Malinka’s computers, they discovered that he had wiped their hard disks. Malinka  strenuously denied having anything to do with Madeleine's disappearance and even claimed that he was beaten up by police during the interrogation to try to get him to admit his involvement. Reports suggested that it was the third time a vehicle of his had mysteriously been set alight close to his home in the middle of the night, the previous attacks having been before Madeleine's disappearance. At this point we might recap and remind ourselves that Malinka’s role was supposed to be that of designing a website for Murat’s new company, ‘Romigen’. However, the following relevant facts came to light about this website:
  • apparently no content had been registered on the site until 18 May 2007 (three days after Murat was made ‘arguido’, according to the internet archive site, ‘Way Back Machine’)
  • it did not seem to have been compiled for use by the general public
  • it had no properties to sell
  • it was in any event full of spelling mistakes and grammatical errors.

The website’s creator was named not as Sergei Malinka but as Nik Legalhoff, one of several aliases used by Malinka, a curiosity in itself. A Mr Nik Legalhoff has been traced to 22 Komunisticheskaya Street, Tiraspol, Moldova, formerly part of Romania, according to the registration details of his internet domain name. It is possible that Segrei Malinka and Nik Legalhoff are one and the same person. More likely, judging by photographs of a person said to be Nik Legalhoff on the internet, is that Nik Legalhoff is just another of Malinka’s many aliases. He had perhaps stolen the identity of another web designer.
It remains a fact that Malinka used the name Nik Legalhoff as a signature within the code of the Romigen website which he said he was designing. If you use a signature in your code, it’s generally to promote yourself or your company, and maybe also for copyright purposes. It seems that either the site wasn’t really developed by Malinka, but by someone else that he knew, or perhaps Malinka wanted to hide his association with the site, even prior to Madeleine’s disappearance. Another possibility is that Malinka altered the name in the code after Madeleine went missing and when it became clear that his frequent contacts with Murat had come to the attention of the police.
Other names he has used are Nikolai Fedorenko and Petrov Ivan Nikolaevich, Russians who have been dead nine and nearly 100 years respectively. Fedorenko represented the Soviet Union at the U.N. where he was known for his anti-Semitism, while Nikolaevich was also a nationalist who expressed anti-Jewish sentiment. In his Nik Legalhoff persona, he appears to be into heavy metal, his favourite long titles including Theatre of Tragedy, Radioactive Toy, Fear of a Blank Planet, Perfection or Vanity, Angel Gets Caught in the Beauty Trap, and Cowboys from Hell.
Malinka had previously worked on designing a website, ividoehomes.com, with business partner Matthew Fazackerley for Monaco property dealer Jeff Mason. His other work included work for the ‘Island Expeditions’ website and for ‘Corlett Actividades Maritimas Limitada' (www.corlettmaritima.com), the former dealing in boats trips in and around the Mediterranean to the West Coast of Africa and the latter specialising in expeditions to São Tomé and Principé.).
Malinka and Fazackerley had also linked together to run a tour operation business, organising the tours. They also had an IT project ‘for the community’, in which they pledged to support children and young people in the community by providing IT, computers and skills training to them. Besides website design, his other interests included photography and server-side technologies. Most of the websites associated with Malinka, including niklegaloff.com, seem to have disappeared by early 2008.

One would have thought the young stars of Toddlers & Tiaras stars were exploited enough on the outrageous pageant reality show.
But seemingly ambitious mothers of the hapless children are prepared to go even further in their pursuit of fame and fortune.
In what many would deem an entirely inappropriate move, five-year-old Toddlers star Isabella Barrett was booked for an appearance in a New York nightclub, where she sang and danced along to an obscene song in front of a crowd of cheering adults.

Dressed in a sugar-pink tutu, the little girl was accompanied by her mother as she took to the stage at a charity fundraising event on Monday night.
And it was her mother who pushed her daughter on when the first deafening notes of LMFAO's pop song I'm Sexy And I Know It pumped out of the sound system.

Her enthusiastic mother looks to be enjoying the raucous event far more than her bemused-looking child, whose confused eyes scan the cheering crowd.

The five-year-old initially made waves when her episode of Toddlers & Tiaras was screened last month.
Isabella was filmed criticising fellow Toddlers star Paisley Dickey for dressing like a prostitute. The little girl appeared to be fed the lines from someone off-screen, suspected to be her mother.

Isabella was referring to one of the series' most shocking scenes to date, where three-year-old Paisley Dickey was dressed up by her mother as Julia Roberts' prostitute character from Pretty Woman.
The distasteful scenes are just some in a long line of outrageous footage to come from the TLC reality show, which has also seen a two-year-old dance on stage dressed as a buxom miniature Dolly Parton.
Last week's episode plumbed new depths when a pageant mother admitted to spiking her daughter's drinks with what she called 'pageant crack', and giving her so-called go-go-juice to animate her ahead of her stage performance.
The show has caused outcry with many who believe it could have a negative influence on youngsters calling for its ban.
Campaigners have set up Facebook group 'Take "Toddlers And Tiaras" off the Air!' in a bid to have the plug pulled in the show.
